le Sezioni Unite della Corte di Cassazione n. 18287 del 2018, con una pronuncia dalla portata innovativa, hanno riconosciuto all’assegno di divorzio in favore dell’ex-coniuge oltre alla funzione assistenziale anche la funzione compensativa e perequativa.

Dunque, ai sensi dell’art. 5, comma 6 della L. n. 898 del 1970, accertata l’assenza di mezzi adeguati del richiedente, l’impossibilità oggettiva di poterseli procurare e la disparità economica tra i due coniugi, il Giudice dovrà indagarne le ragioni e dunque dovrà valutare in concreto:

~ il contributo fornito dall’ex-coniuge richiedente alla condizione di vita familiare e alla formazione del patrimonio comune;

vi sono i presupposti per ricorrere al Giudice dell’Appello. Questa volta, però, cercando di fare valere in modo più incisivo tutto l’apporto, i sacrifici e i compromessi che ha dovuto sostenere e sopportare, per 20 anni di matrimonio.

The United Sections of the Court of Cassation no. 18287 of 2018, with a ruling of innovative scope, recognised the divorce cheque in favour of the former spouse as a compensatory and equalising function in addition to the welfare function.

Therefore, pursuant to Article 5, paragraph 6 of Law no. 898 of 1970, having ascertained the absence of adequate means of the applicant, the objective impossibility of obtaining them and the economic disparity between the two spouses, the Judge will have to investigate the reasons and, therefore, will have to evaluate in concrete terms:

~ the contribution made by the applicant’s former spouse to the condition of family life and to the formation of the common heritage;

there are the conditions to appeal to the Appellate Judge. This time, however, trying to make more incisive use of all the contribution, sacrifices and compromises that she had to sustain and endure, for 20 years of marriage.
