Separazioni e divorzi online: le linee guida del Cnf

Il Consiglio Nazionale Forense constatata la fase emergenziale e sottolinea la necessità di assicurare l’esecuzione del procedimento in materia di diritto di famiglia.

Nei mesi di maggio e di giugno sarà ancora necessario evitare assembramenti e contatti ravvicinati tra le persone che, per lavoro e fruizione, frequentano gli uffici giudiziari. Tuttavia, oltre alle esigenze di tutela della salute pubblica (art. 32 Cost.), durante questo periodo di emergenza sanitaria appare necessario assicurare anche la tutela della famiglia ( (art. 29 e 30 Cost.)

Per questo il Consiglio Nazionale Forense ha avallato delle linee guida riguardanti i procedimenti in materia di diritto di famiglia nella fase di emergenza Covid-19 e a seguito delle misure straordinarie e urgenti messe in atto dal Governo che tengono conto dell’eccezionalità della situazione “limitatamente al periodo di emergenza e comunque non oltre la data del 30 giugno 2020”.

Il CNF constata che tutti i procedimenti in materia di famiglia siano per loro natura connotati da urgenza di provvedere o di non doversi ulteriormente protrarre nel tempo. I difensori, quindi, valutano, e decidono  quale è la scelta più adatta alle necessità e alla tutela del proprio assistito anche alla luce delle esigenze dei minori coinvolti. The National Forensic Council noted the emergency phase and stressed the need to ensure the enforcement of family law proceedings.

In the months of May and June, it will still be necessary to avoid close gatherings and contacts between people who, for work and use, attend judicial offices. However, in addition to the need to protect public health (art. 32 Cost.), during this period of health emergency it seems necessary to ensure the protection of the family (art. 29 and 30 Cost.).
For this reason, the National Forensic Council has endorsed guidelines regarding family law proceedings during the Covid-19 emergency phase and following the extraordinary and urgent measures implemented by the Government that take into account the exceptional nature of the situation “limited to the emergency period and in any case no later than 30 June 2020”.

The CNF notes that all family proceedings are, by their very nature, characterised by the urgency of taking action or not having to be prolonged further. The defendants, therefore, assess and decide which is the most suitable choice for the needs and protection of their clients, also in light of the needs of the minors involved.
