In caso di separazione le vacanze da trascorrere con i figli richiedono spesso un grande sforzo organizzativo tra i genitori.

Nei casi di separazione e di divorzio, così come a seguito della cessazione della convivenza more uxorio, in presenza di figli minorenni ed in regime di affidamento condiviso, le vacanze estive sono oggetto di specifica regolamentazione giuridica nell’ambito della più generale definizione del calendario di visite stabilito dal Tribunale nell’interesse della prole.

Di solito è anche prevista la data entro la quale i genitori devono accordarsi sulle rispettive ferie, normalmente stabilita entro la fine di maggio.

Pertanto, quando si parla di vacanze con i figli di genitori separati le decisioni più importanti sono rimesse alla volontà comune delle parti, sancita dal provvedimento giudiziale che omologa la separazione consensuale o alla sentenza che ha concluso il procedimento di separazione giudiziale.

Da tali disposizioni ed accordi derivano, infatti, obblighi ben precisi per i due genitori che, se non rispettati, possono portare a delle conseguenze.

Se un genitore vuole partire per le vacanze con i propri figli deve comunicare in tempo all’altro l’indirizzo dell’albergo o dell’appartamento in cui alloggerà.

Inoltre, il genitore lontano dal proprio figlio deve poter comunicare con il minore e per questo è necessario indicare un recapito telefonico, diverso dal cellulare, del luogo in cui il genitore trascorrerà le vacanze con il figlio.

Il mancato rispetto di tale obbligo, se per la giurisprudenza di merito non comporta conseguenze sul piano penale, viola senza dubbio il dovere di collaborazione che grava su entrambi i genitori per l’interesse della famiglia, contemplato dall’art. 143 del codice civile.

Come ha avuto modo di precisare del resto la Corte d’Appello di Torino in data 26/02/2008 “Rientra comunque, in ogni caso, nelle regole di buona prassi ed è conforme alla cura condivisa della prole che ognuno dei genitori avverta l’altro del luogo ove avesse a condurre il minore e del periodo di permanenza colà”.

Di fronte alla mancata comunicazione della destinazione specifica delle vacanze con i figli, l’altro genitore ha la possibilità di attivarsi presentando eventualmente un ricorso per la modifica delle condizioni di affidamento del minore ai sensi dell’art. 337 quinques o un ricorso 709 ter c.p.c. al giudice del procedimento di separazione, competente a risolvere proprio le controversie che insorgono tra genitori in ordine all’esercizio della responsabilità genitoriale o alle modalità di affidamento.

In questi casi, se l’inadempimento del genitore è grave, il giudice potrà ammonire il genitore, disporre il risarcimento del danno in favore dell’altro, condannare il genitore inadempiente a pagare una sanzione amministrativa pecuniaria minima di 75 euro e massima di 5.000 euro alla Cassa delle ammende.

Un altro rimedio esperibile in caso di esercizio della responsabilità genitoriale, se non pende alcun procedimento di separazione o divorzio, è il ricorso al giudice tutelare ai sensi dell’art. 337 c.c.

Per quanto riguarda, invece, le spese relative alle vacanze, queste dovranno essere sostenute interamente dal genitore con cui il figlio trascorrerà le stesse.

Infine, si precisa che il genitore non collocatario è tenuto comunque a pagare la mensilità del mantenimento anche nel mese in cui è in vacanza con il figlio (Corte di Cassazione n. 18869/2014).

Summer vacations and separated parents

In the event of separation, the vacations to be spent with the children often require a great deal of organizational effort between the parents.

In cases of separation and divorce, as well as following the termination of cohabitation, in the presence of minor children and in shared custody, the summer vacations are subject to specific legal regulations within the more general definition of the calendar of visits established by the Court in the interest of the child.

There is also usually a date by which parents must agree on their respective vacations, normally set by the end of May.

Therefore, when it comes to vacations with the children of separated parents, the most important decisions are left to the common will of the parties, sanctioned by the court decision approving the separation by mutual consent or by the judgement that concluded the judicial separation proceedings.

From these provisions and agreements, in fact, derive very precise obligations for both parents that, if not respected, can lead to consequences.

If one parent wants to go on vacation with his or her children, he or she must inform the other in time of the address of the hotel or apartment where he or she will be staying.

In addition, the parent who is away from his or her child must be able to communicate with the child, and for this it is necessary to indicate a telephone number, other than a cell phone number, of the place where the parent will spend the vacations with the child.

Failure to comply with this obligation, even if, according to the jurisprudence of merit, it does not entail criminal consequences, undoubtedly violates the duty of cooperation incumbent on both parents for the interest of the family, contemplated by art. 143 of the Civil Code.

As stated by the Court of Appeal of Turin on 26/02/2008: “In any case, it is part of the rules of good practice and is consistent with the shared care of the child that each parent informs the other of the place where he/she will take the child and the period of stay there.

Faced with the lack of communication of the specific destination of the vacation with the children, the other parent has the possibility to take action by filing an appeal for the modification of the conditions of custody of the child pursuant to art. 337 quinques or an appeal 709 ter c.p.c. to the judge of the separation procedure, competent to resolve precisely the disputes that arise between parents with regard to the exercise of parental responsibility or the methods of custody.

In such cases, if the failure of the parent is serious, the judge may admonish the parent, order compensation for damages in favor of the other, condemn the defaulting parent to pay a minimum fine of 75 euros and a maximum of 5,000 euros to the Fine Fund.

Another remedy available in case of exercise of parental responsibility, if no separation or divorce proceedings are pending, is the recourse to the tutelary judge pursuant to art. 337 Civil Code.

As regards, however, the expenses related to the vacations, these must be borne entirely by the parent with whom the child will spend the same.

Finally, it should be pointed out that the non-collocating parent is still required to pay the monthly maintenance fee even in the month in which he or she is on vacation with the child (Court of Cassation no. 18869/2014).
