Condannato il padre che non mantiene i figli anche se non li vede sentenza Cassazione 12681/2020

La Corte di Cassazione con la sentenza n. 12681/2020 respinge il ricorso di un padre, accusato in primo e secondo grado per il reato di violazione degli obblighi di assistenza familiare, per aver fatto mancare ai figli il mantenimento stabilito dal provvedimento di omologa della separazione.

A fronte dell’affermata impossibilità economica di provvedere, che la Corte di Cassazione non ha ritenuto provata, è piuttosto emerso dalle dichiarazioni concordanti e precise della persona offesa che lo stesso si è piuttosto disinteressato completamente delle necessità, anche economiche dei figli, mantenuti dalla mamma grazie a lavori saltuari e dai genitori della stessa.

The Court of Cassation with sentence no. 12681/2020 rejects the appeal of a father, accused in first and second instance for the crime of violation of family assistance obligations, for having made the children lack the maintenance established by the separation homologation measure.

In the face of the alleged economic impossibility of providing, which the Court of Cassation did not deem to be proven, it rather emerged from the statements of the injured party that he was rather completely disinterested in the needs, including the financial needs of the children, supported by the mother thanks to occasional work and by her parents.
