I figli vengono, vengono affidati al Comune, quando i genitori sono molto litigiosi

Con sentenza dell’11 febbraio 2021, n. 1145, il Tribunale di Milano, nel dichiarare la separazione giudiziale tra i coniugi, ha disposto il collocamento paritario delle figlie presso entrambi i genitori ed il contestuale affidamento al Comune, incaricato di assumere le decisioni di maggior interesse relative alla loro istruzione, educazione, salute e residenza.

I giudici del Tribunale, hanno ritenuto che l’accesa animosità tra i coniugi, all’esito della relazione peritale,   ha evidenziato  una fragilità emotiva che li rende incapaci di distinguere il piano della genitorialità da quello della crisi di coppia e di rispondere in maniera efficace ai bisogni delle figlie, ha rappresentato il presupposto per una limitazione della responsabilità genitoriale.

Com’è noto, infatti, in base all’art. 333 c.c.: “Quando la condotta di uno o di entrambi i genitori non è tale da dare luogo alla pronuncia di decadenza prevista dall’articolo 330, ma appare comunque pregiudizievole al figlio, il giudice, secondo le circostanze, può adottare i provvedimenti convenienti”.
Nella fattispecie, il regime di affidamento etero familiare è stato, dunque, considerato l’unica soluzione praticabile, al fine di scongiurare il rischio evolutivo delle figlie minori, pesantemente invischiate in una situazione di profondo conflitto, da lungo tempo insostenibile.

All’ente affidatario è stato, pertanto, demandato di svolgere un’attenta e marcata attività di monitoraggio dell’intero nucleo familiare, anche per tramite dei servizi sociali, con delega a vigilare sulla regolarità e serenità delle frequentazioni e ad avviare tutti gli interventi ritenuti opportuni per l’aiuto psicologico alla famiglia: sia in termini di percorsi psicoterapici individuali, sia in termini di supporto mirato all’implementazione delle capacità dei genitori. L’amministrazione locale viene, dunque, considerata come una sorta di anello di congiunzione tra genitori, professionisti delle strutture socio -educative e organi giudiziari, nell’ottica di un complesso “lavoro di rete”.

La sentenza ha, in tal senso, imposto a carico dell’amministrazione l’obbligo di riferire periodicamente al Giudice tutelare sull’andamento della vita familiare e di segnalare immediatamente alla Procura della Repubblica presso il Tribunale dei Minori eventuali situazioni di grave pregiudizio per le minori.

Il provvedimento ha, infine, prescritto ad entrambi i genitori di attenersi alle statuizioni del Tribunale, prestando agli operatori la massima collaborazione, avvisandoli che, in caso di mancata fattiva collaborazione, potranno essere assunti ulteriori provvedimenti limitativi della responsabilità genitoriale

In its judgment No. 1145 of 11 February 2021, the Court of Milan, in declaring the judicial separation of the spouses, ordered that the children be placed on an equal footing with both parents and, at the same time, entrusted to the Municipality, which is responsible for making the decisions of greatest interest concerning their education, upbringing, health and residence.

The judges of the Court of First Instance considered that the heated animosity between the spouses, at the outcome of the expert’s report, showed an emotional fragility that made them unable to distinguish the parental level from that of the couple’s crisis and to respond effectively to their daughters’ needs, and constituted the basis for a limitation of parental responsibility.

As is well known, in fact, according to Article 333 of the Civil Code: “When the conduct of one or both parents is not such as to give rise to the pronouncement of disqualification provided for in Article 330, but still appears prejudicial to the child, the judge, according to the circumstances, may take the appropriate measures”.

In the present case, hetero-family custody was therefore considered the only feasible solution, in order to avert the developmental risk of the minor daughters, who were heavily entangled in a situation of deep conflict that had been unsustainable for a long time.

The local authority has therefore been entrusted with the task of carefully monitoring the entire family, also through the social services, and has been delegated to supervise the regularity and serenity of the family’s relations and to initiate all the interventions deemed appropriate to provide psychological support to the family: both in terms of individual psychotherapy and in terms of support aimed at implementing the parents’ skills. The local administration is therefore considered to be a sort of link between parents, professionals in the socio-educational structures and judicial bodies, with a view to a complex ‘network work’.

The judgment imposed on the administration the obligation to report periodically to the tutelary judge on the progress of family life and to report immediately to the Public Prosecutor’s Office at the Juvenile Court any situation of serious harm to minors.

Lastly, the court ordered both parents to abide by the court’s provisions and to cooperate as much as possible with the operators, warning them that, if they did not cooperate, further measures restricting parental responsibility could be taken.
