L’addebito della separazione al marito per aver intrattenuto una relazione extraconiugale può essere provato anche dallo scambio di messaggi fra moglie e amante

In un procedimento per separazione personale dei coniugi, la moglie formulava richiesta di addebito della separazione al marito perché questi aveva intrattenuto una relazione extra-coniugale in costanza di matrimonio con una signora, con la quale sarebbe, poi, andato a convivere.

Si opponeva il marito, adducendo che la causa della crisi coniugale fosse in realtà una sopravvenuta incompatibilità caratteriale tra i coniugi risalente a molti anni prima.

La difesa della moglie contestava la ricostruzione fornita dal marito, rilevando come i coniugi negli ultimi anni avessero deciso di acquistare una casa per la famiglia, contraendo un mutuo, e, soprattutto, di avere un altro figlio. Pochi mesi dopo la nascita del bambino la moglie avrebbe scoperto la relazione extraconiugale del marito, confermata da questi ed ammessa dalla stessa amante, con la quale la moglie avrebbe avuto un fitto scambio di messaggi via WhatsApp.

Il rapporto coniugale, quindi, sarebbe stato irrimediabilmente compromesso della relazione extraconiugale intrattenuta dal marito con l’attuale compagna, con cui egli attualmente convive.

il Giudice ha poi richiamato un altro principio consolidato in giurisprudenza (Cass. sez. 6-1, ord. n. 3923 del 19/02/2018; conforme: sez. 1, sent. n. 2059 del 14/02/2012): ai sensi dell’art. 2697 c.c., la parte che richiede l’addebito della separazione all’altro coniuge, per l’inosservanza dell’obbligo di fedeltà, ha l’onere di provare non solo la condotta infedele, ma soprattutto che proprio questa abbia reso irrimediabilmente intollerabile la prosecuzione della convivenza.

E’, invece, onere di chi eccepisce l’inefficacia dei fatti posti a fondamento della domanda provare che la crisi matrimoniale sussisteva già prima dell’accertata infedeltà.

Nel caso di specie, l’istruttoria svolta aveva permesso di dimostrare che la relazione extraconiugale del marito era pacificamente anteriore alla crisi coniugale e che questa aveva causato la fine del matrimonio ed il definitivo allontanamento del marito dalla casa coniugale.

L’anteriorità della relazione extraconiugale era comprovata dalla testimonianza della attuale compagna del marito, la quale aveva confermato di aver scritto i messaggi WhatsApp inviati alla moglie in cui riconosceva l’esistenza della relazione nel corso del matrimonio

L’anteriorità della relazione era suffragata anche dalla condotta del marito che, dopo aver abbandonato la casa coniugale, si era trasferito senza soluzione di continuità presso l’abitazione dell’amante, a soli sei mesi dalla nascita del suo terzo figlio.

Il Tribunale ha quindi ritenuto fondata la richiesta di addebito della separazione personale dei coniugi a carico del marito.

In a procedure for the separation of the spouses, the wife requested the husband to be charged with the separation on the grounds that he had had an extra-marital relationship with a lady, with whom he would then live together.

The husband objected, arguing that the cause of the marital crisis was in fact a character incompatibility between the spouses dating back many years.

The wife’s defence contested the reconstruction provided by her husband, noting how the couple had decided in recent years to buy a house for the family, taking out a mortgage, and, above all, to have another child. A few months after the birth of the child, the wife would discover her husband’s extramarital affair, confirmed by the husband and admitted by his mistress, with whom the wife would have had a close exchange of messages via WhatsApp.

The conjugal relationship, therefore, would have been irreparably compromised by the husband’s extramarital relationship with his current partner, with whom he currently lives.

The Judge then referred to another principle consolidated in jurisprudence (Civil cassation section 6-1, order no. 3923 of 19/02/2018; compliant: section 1, sentence no. 2059 of 14/02/2012): pursuant to article 2697 of the Italian Civil Code, the party requesting the charge of the separation to the other spouse, due to the non-observance of the obligation of fidelity, has the burden of proving not only the unfaithful conduct, but above all that this has made the continuation of cohabitation irreparably intolerable.

It is, on the other hand, the burden of the person who claims that the facts underlying the claim are ineffective to prove that the marriage crisis already existed before the established infidelity.

In the present case, the investigation carried out made it possible to prove that the extramarital relationship of the husband had peacefully preceded the marital crisis and that this had caused the end of the marriage and the definitive removal of the husband from the marital home.

The antecedence of the extramarital relationship was proven by the testimony of the husband’s current partner, who confirmed that she had written the WhatsApp messages sent to his wife in which she acknowledged the existence of the relationship during the marriage.

The earlier relationship was also supported by the conduct of her husband who, after leaving the matrimonial home, had moved seamlessly into her lover’s home, only six months after the birth of her third child.

The Court therefore held that the request to charge the husband with the separation of the spouses was well-founded.
