L’assegno divorzile può essere richiesto per la prima volta nel giudizio per la modifica delle condizioni di divorzio

Mantenimento del coniuge

IL CASO. Con ricorso ex art. 9 L. n. 898 del 1970 per la modifica delle condizioni di divorzio, l’ex moglie chiedeva al Tribunale di Bari l’attribuzione dell’assegno divorzile, precedentemente non richiesto (e dopo non aver richiesto un assegno nemmeno in sede di separazione), nonché l’aumento del contributo paterno al mantenimento dei figli minori e il pagamento da parte dell’ex marito delle spese condominiali relative alla casa familiare.

Si opponeva l’ex marito, chiedendo a sua volta la riduzione dell’assegno di mantenimento in favore dei figli e la revoca dell’assegnazione della casa coniugale all’ex moglie.

Il Tribunale di Bari rigettava tutte le domande proposte da entrambe le parti.

In parziale accoglimento del reclamo proposto dalla signora, la Corte d’Appello di Bari poneva a carico del resistente l’obbligo di corrispondere all’ex moglie la somma mensile di € 600,00 a titolo di assegno divorzile, nonché di contribuire alle spese straordinarie per i figli nella misura del 70%.

La Corte d’Appello, dopo aver comparato redditi e patrimoni degli ex coniugi, ne rilevava uno squilibrio, non sussistente all’epoca della separazione e del divorzio, da un lato per il sopravvenuto considerevole decremento dei redditi dell’ex moglie derivanti dalla sua attività professionale di avvocato negli anni successivi al 2010, dall’altro per la complessiva capacità reddituale ed economico-patrimoniale dell’ex marito.

L’ex marito proponeva ricorso per la cassazione del provvedimento.

DECISIONE. La Corte di Cassazione ha preliminarmente ricordato come sia possibile avanzare per la prima volta istanza di riconoscimento di assegno divorzile nel procedimento di modifica delle condizioni di divorzio ex art. 9 Legge 898 del 1970, anche laddove nel procedimento di separazione personale dei coniugi e nel procedimento di divorzio mai sia stato chiesto. A favore di tale orientamento si era già espressa la Suprema Corte con sentenza n. 25327/2017 e, prima ancora, con sentenza n. 108/2014.

Anche in tale caso, il Giudice deve uniformarsi ai principi affermati dalla Corte di Cassazione a Sezioni Unite nella sentenza n. 18287/2018, per i quali all’assegno va attribuita una funzione assistenziale ed in pari misura compensativa e perequativa.

Ai fini del riconoscimento dell’assegno divorzile, dev’essere preliminarmente accertata la sussistenza del requisito dell’”inadeguatezza dei mezzi dell’ex coniuge istante e dell’impossibilità di procurarseli per ragioni oggettive”, previa “valutazione comparativa delle condizioni economico-patrimoniali delle parti, in considerazione del contributo fornito dal richiedente l’assegno divorzile alla conduzione della vita familiare ed alla formazione del patrimonio comune, nonché di quello personale di ciascuno degli ex coniugi, in relazione alla durata del matrimonio ed all’età dell’avente diritto”.

Va, pertanto, riconosciuto un contributo idoneo al raggiungimento in concreto di un livello reddituale adeguato al ruolo assunto e al contributo fornito nella realizzazione della vita familiare, nella formazione del patrimonio della famiglia e di quello personale degli ex coniugi, tenendo conto delle aspettative professionali sacrificate.

Nel giudizio di revisione che venga instaurato a notevole distanza di tempo dal momento della definitiva cessazione del rapporto matrimoniale, può non essere facile individuare la correlazione tra l’inadeguatezza sopravvenuta dei mezzi del richiedente e il ruolo endofamiliare da questi svolto e i sacrifici professionali conseguitine, soprattutto laddove, come nel caso di specie, la disparità economica sia un fatto sopravvenuto, ossia non sussistente all’epoca dello scioglimento del vincolo matrimoniale.

Ne consegue che può rivestire carattere di prevalenza la finalità assistenziale dell’assegno quando il giudice di merito accerti che “il sopravvenuto, e incolpevole, peggioramento della condizione economica di vita di uno degli ex coniugi non sia altrimenti suscettibile di compensazione per l’assenza di altri obbligati o di altre forme di sostegno pubblico e che l’ex coniuge, meglio dotato nel patrimonio e capace di fornire una qualche forma di erogazione, abbia in passato ricevuto o goduto di apporti significativi, pur se non incidenti, quando il vincolo matrimoniale si è estinto, sull’equilibrio economico tra i coniugi, da parte di quello successivamente impoveritosi e bisognoso di un sostegno alimentare, in senso ampio”.

Nel caso di specie, la Suprema Corte ha quindi cassato il decreto della Corte d’Appello, alla quale la causa è stata rimessa affinché i giudici di merito possano accertare se vi sia nesso causale tra la situazione economica attuale dell’ex moglie e le pregresse dinamiche familiari di rilevanza.

Spousal maintenance

THE CASE. In an appeal pursuant to article 9 of Law no. 898/1970 to modify the conditions of divorce, the ex-wife asked the Court of Bari to award her divorce allowance, which she had not previously requested (and after not having requested an allowance even at the time of separation), as well as to increase her father’s contribution to the maintenance of the minor children and for the ex-husband to pay the condominium expenses relating to the family home.

The ex-husband opposed, requesting in turn a reduction in the maintenance allowance for the children and the revocation of the assignment of the marital home to his ex-wife.

The Court of Bari rejected all the claims brought by both parties.

The Court of Appeal of Bari upheld part of the woman’s complaint and ordered the respondent to pay his ex-wife the monthly sum of €600 by way of divorce allowance, as well as to contribute 70% of the extraordinary expenses for the children.

The Court of Appeal, after comparing the former spouses’ incomes and assets, found that there was an imbalance, which did not exist at the time of the separation and divorce, on the one hand because of the considerable decrease in the former wife’s income from her professional activity as a lawyer in the years after 2010, and on the other hand because of the former husband’s overall income and financial capacity.

The ex-husband appealed against the decision.

DECISION. The Court of Cassation first of all recalled that it is possible to apply for divorce allowance for the first time in proceedings for the modification of the conditions of divorce under Article 9 of Law 898/1970, even if no such application was ever made in the proceedings for the legal separation of the spouses and in the divorce proceedings. The Supreme Court had already ruled in favour of this approach in judgment no. 25327/2017 and, before that, in judgment no. 108/2014.

Also in this case, the judge must follow the principles established by the Court of Cassation (United Sections) in judgment no. 18287/2018, according to which the allowance must be attributed a welfare function and in equal measure compensatory and equalizing.

For the purpose of the recognition of the divorce allowance, the existence of the requirement of the “inadequacy of the means of the former spouse petitioner and the impossibility of obtaining them for objective reasons”, after a “comparative assessment of the economic and financial conditions of the parties, in consideration of the contribution made by the applicant for divorce allowance to the conduct of family life and the formation of common wealth, as well as the personal contribution of each of the former spouses, in relation to the duration of the marriage and the age of the entitled person”, must be ascertained first.

It is therefore necessary to recognise an appropriate contribution to the attainment of a level of income appropriate to the role taken on and the contribution made to the conduct of family life, the formation of the family fortune and the personal fortune of the former spouses, taking into account the professional expectations sacrificed.

In review proceedings initiated a long time after the definitive termination of the marriage, it may not be easy to identify the correlation between the applicant’s supervening inadequacy of means and the intra-familial role played by him/her and the professional sacrifices made, especially where, as in the present case, the economic disparity is a supervening fact, i.e. not existing at the time of the dissolution of the marriage bond.

It follows that the welfare purpose of the allowance may take precedence when the court of merit finds that “the supervening, and irresponsible, worsening of the economic condition of one of the former spouses is not otherwise susceptible to compensation for the absence of other obligors or other forms of public support and that the former spouse, The former spouse, who is better endowed and able to provide some form of support, has in the past received or enjoyed significant contributions, even if they did not affect the economic balance between the spouses when the marriage relationship ended, from the one who subsequently became impoverished and in need of maintenance support, in the broader sense”.

In the present case, the Supreme Court has therefore overturned the decree of the Court of Appeal, to which the case has been referred so that the judges of merit can ascertain whether there is a causal link between the ex-wife’s current economic situation and the previous relevant family dynamics.
