Se si amplia il diritto di visita e frequentazione dei figli da parte del padre si riduce il contributo al loro mantenimento

La Corte di Cassazione, con l’ordinanza n. 3203 emessa il 15.12.2020, ha affermato il principio per cui l’ampliamento del diritto di visita delle figlie minori a favore del padre e il conseguente obbligo di mantenimento diretto durante la permanenza delle stesse presso di lui, giustifica la riduzione del mantenimento dovuto alla madre per le spese ordinarie delle figlie.

Nel caso esaminato, la Corte di Appello di Venezia, in ordine al ricorso promosso dal padre per la modifica delle condizioni di affidamento delle figlie minori, nate fuori dal matrimonio, e di riduzione dell’assegno disposto per il loro mantenimento ordinario, aveva confermato la decisione di primo grado del Tribunale di Rovigo quanto alla collocazione prevalente delle figlie minori presso la madre, ma con diversa e più ampia modalità di frequentazione e soggiorno delle stesse presso il padre, accogliendo però il reclamo quanto alla richiesta di riduzione del contributo al mantenimento.

La Corte territoriale, infatti, riduceva il contributo al mantenimento ordinario per le figlie da versare alla madre, disponendo il mantenimento diretto delle due minori da parte del padre nel periodo in cui le figlie coabitavano con lui.

In particolare, i giudici d’appello hanno sostenuto che “la riduzione di tale contributo si poteva giustificare con l’ampliamento del diritto di visita del padre e con il regime di mantenimento diretto della prole, non trascurato il fatto che le minori vivevano molte ore in educandato”.

Avverso la suddetta pronuncia proponeva ricorso per Cassazione la madre, lamentando, in particolare, ex art. 360 n. 3 c.p.c., la violazione e falsa applicazione dell’art. 156 ultimo comma c.c., quanto ai presupposti della revoca o modifica dei provvedimenti adottati.

La Corte di Cassazione ha rigettato il ricorso presentato dalla madre delle minori e ha confermato la decisione della Corte di Appello, affermando che “il nuovo regime derivante dalla riforma della filiazione introdotta dalla l. n. 219 del 2012 e dal d.lgs. n. 154 del 2013, teso ad assicurare l’uniformità di regolazione giuridica della responsabilità genitoriale in sede separativa, divorzile ed in relazione ai figli nati fuori dal matrimonio, ha introdotto l’art. 337 quinquies c.c., che contempla la possibilità per ogni genitore di chiedere la revisione delle disposizioni concernenti l’affidamento dei figli, l’attribuzione dell’esercizio della responsabilità genitoriale su di essi e delle eventuali disposizioni alla misura e modalità del contributo”.

The Court of Cassation, in its order no. 3203 issued on 15.12.2020, affirmed the principle that the extension of the father’s right of access to his minor daughters and the consequent obligation to maintain them directly while they are with him, justifies a reduction in the amount of maintenance owed to the mother for the daughters’ ordinary expenses.

In the case under consideration, the Court of Appeal of Venice, ruling on the appeal brought by the father for a modification of the conditions of custody of his minor daughters, born out of wedlock, and for a reduction in the allowance for their ordinary maintenance, confirmed the decision of the Court of First Instance of Rovigo as regards the placement of the minor daughters with their mother, but with a different and wider mode of attendance and stay of the same with their father, but upheld the complaint concerning the request for a reduction in the contribution to maintenance.

The local court reduced the amount of ordinary maintenance to be paid to the mother for the daughters, and ordered the father to maintain the two minors directly while the daughters were living with him.

In particular, the appeal judges held that “the reduction of this contribution could be justified by the extension of the father’s visitation rights and the direct maintenance of the children, not forgetting the fact that the minors lived many hours in a boarding school”.

The mother appealed to the Court of Cassation against this decision, complaining, in particular, pursuant to article 360 no. 3 of the Code of Civil Procedure, of the violation and misapplication of article 156, last paragraph, of the Civil Code, as regards the conditions for revoking or modifying the measures adopted.

The Court of Cassation rejected the appeal filed by the mother of the minors and confirmed the decision of the Court of Appeal, stating that “the new regime resulting from the reform of filiation introduced by law no. 219 of 2012 and legislative decree no. 154 of 2013, aimed at ensuring the uniformity of legal regulation of parental responsibility in separation, divorce and in relation to children born out of wedlock, introduced art. 337 quinquies Civil Code, which provides for the possibility for each parent to request the revision of the provisions concerning the custody of the children, the attribution of the exercise of parental responsibility over them and of any provisions on the extent and manner of contribution”.
