La ripartizione della pensione di reversibilità tra coniuge divorziato e coniuge superstite: conta solo la durata del matrimonio?

L’ordinanza della Corte di Cassazione, Sez. lavoro, n. 8263 del 28.04.2020, ritorna sulla questione dei criteri di ripartizione della pensione di reversibilità tra ex coniuge e coniuge superstite, precisando che la ripartizione deve tener conto, oltre al criterio della durata dei matrimoni, anche di altri elementi correttivi, quali l’entità dell’assegno divorzile a favore dell’ex coniuge, le condizioni economiche dei soggetti interessati ed anche la durata delle convivenze prematrimoniali.


The distribution of the survivor’s pension between divorced and surviving spouse: does only the duration of the marriage count?

The order of the Court of Cassation, Employment Section, no. 8263 of 28.04.2020, returns to the question of the criteria for the distribution of the survivor’s pension between the former spouse and the surviving spouse, specifying that the distribution must take into account, in addition to the criterion of the duration of the marriages, also other corrective elements, such as the amount of the divorce allowance in favour of the former spouse, the economic conditions of the persons concerned and also the duration of premarital cohabitation.
