NIENTE ASSEGNO ALLA EX MOGLIE SE LA RELAZIONE STABILE È CONFERMATA DAI SOCIAL

L’ex coniuge perde il diritto a ricevere l’assegno di divorzio qualora tramite i contenuti pubblicati sui social viene confermata l’esistenza di un rapporto pluriennale e consolidato con una nuova persona, caratterizzato da ufficialità, nonché fondato sulla quotidiana frequentazione con periodi più o meno lunghi di piena ed effettiva convivenza.

Quanto sopra è ciò che emerge dalla recentissima sentenza n. 15973/2021 emessa in data 13 ottobre 2021 dalla prima sezione civile del Tribunale di Roma.

Come già approfondito in articoli precedenti l’assegno divorzile è quel contributo economico che l’ex coniuge è obbligato a corrispondere a favore dell’altro coniuge quando quest’ultimo non dispone dei mezzi adeguati ovvero si trova in una situazione di oggettiva impossibilità a procurarseli. La funzione dell’assegno divorzile è quella di riconoscere il ruolo ed il contributo fornito dall’ex coniuge economicamente più debole alla formazione del patrimonio della famiglia e di quello personale.

Il diritto a ricevere l’assegno di divorzio tuttavia può essere revocato per diverse cause, tra le quali troviamo il passaggio a nuove nozze da parte del beneficiario del contributo economico. L’art.5 comma 10 della legge sul divorzio, infatti, dispone la cessazione dell’obbligo di corresponsione dell’assegno divorzile se il coniuge beneficiario passa a nuove nozze in quanto quest’ultimo acquisisce il diritto all’assistenza economica nei confronti del nuovo coniuge.

Alla luce del dettato normativo ci si è quindi chiesti se anche l’instaurazione di una nuova convivenza da parte del beneficiario con una persona terza, è in automatico causa di revoca del diritto a percepire l’assegno divorzile. A seguito di un forte e lungo dibattito a livello giurisprudenziale, l’orientamento maggioritario ha stabilito l’automatica cessazione del diritto alla corresponsione del contributo economico poiché l’instaurazione della nuova convivenza ha come conseguenza l’estinzione della responsabilità post matrimoniale in quanto, anche se di fatto, si viene a creare una nuova famiglia. Recentemente inoltre, la Cassazione con sentenza n. 28778 del 20 ottobre 2020 ha affrontato la tematica dell’assegno divorzile nel caso in cui uno dei due ex coniugi avvii una nuova relazione stabile, ridimensionando la rilevanza della convivenza in favore della esistenza di una relazione stabile con un nuovo partner. Secondo quindi il più recente orientamento giurisprudenziale ai fine della cessazione del diritto a ricevere un assegno divorzile è sufficiente l’esistenza di un rapporto pluriennale e consolidato con un nuovo compagno.

Il caso affrontato dalla Prima Sezione Civile del Tribunale di Roma, vedeva una moglie che in sede di divorzio, contestando l’esistenza di una stabile convivenza tra lei ed il nuovo compagno dedotta invece dall’ex marito, chiedeva di porre in capo all’ex coniuge l’onere di corrisponderle una somma mensile a titolo di assegno di divorzio.

La richiesta avanzata dalla signora, sulla base della più recente giurisprudenza ed in applicazione dei principi ormai consolidati, veniva dichiarata priva di ogni fondamento e pertanto rigettata totalmente dal Tribunale di Roma. Il Collegio infatti evidenziava come nel caso in esame la donna si era separata in età molto giovane, vantava di un titolo di studio specializzante che le permetteva di immettersi facilmente nel mercato del lavoro ed inoltre a seguito della separazione era tornata a vivere presso l’abitazione di proprietà della propria famiglia senza quindi dover sostenere alcun costo di locazione.

Oltre a tali elementi, il Collegio evidenziava come nel corso dell’istruttoria svolta era stata confermata la nuova relazione tra la ex moglie ed il nuovo compagno, direttamente dai contenuti social pubblicati della signora. Per tale motivo quindi il Tribunale di Roma – ribadendo il principio giurisprudenziale secondo cui per far venire meno il diritto a ricevere l’assegno divorzile è sufficiente l’esistenza di un rapporto pluriennale e consolidato con una nuova persona, caratterizzato da ufficialità, nonché fondato sulla quotidiana frequentazione con periodi più o meno lunghi di piena ed effettiva convivenza – rigettava la richiesta della moglie.

NO ALLOWANCE TO THE EX-WIFE IF THE STABLE RELATIONSHIP IS CONFIRMED BY SOCIAL NETWORKS

The ex-spouse loses the right to receive the divorce allowance if through the content posted on social networks is confirmed the existence of a long-standing and established relationship with a new person, characterized by officialdom, as well as based on daily attendance with more or less long periods of full and effective cohabitation.

The above is what emerges from the recent judgment no. 15973/2021 issued on October 13, 2021 by the first civil section of the Court of Rome.

As already discussed in previous articles, the divorce allowance is the economic contribution that the former spouse is obliged to pay to the other spouse when the latter does not have adequate means or is in a situation of objective impossibility to procure them. The function of the divorce allowance is to recognize the role and the contribution made by the economically weaker ex-spouse to the formation of the family and personal assets.

The right to receive the divorce allowance, however, can be revoked for various reasons, among which we find the passage to a new marriage by the beneficiary of the economic contribution. Art. 5, paragraph 10 of the divorce law, in fact, provides for the cessation of the obligation to pay the divorce allowance if the beneficiary spouse moves to a new marriage, insofar as the latter acquires the right to economic assistance with regard to the new spouse.

In the light of the law, the question has therefore arisen as to whether the beneficiary’s entering into a new cohabitation with a third party is also an automatic cause of revocation of the right to receive the divorce allowance. Following a strong and long debate at jurisprudential level, the majority orientation has established the automatic termination of the right to the payment of the economic contribution since the establishment of the new cohabitation has as a consequence the extinction of the post-marital responsibility since, even if de facto, a new family is created. Recently, moreover, the Supreme Court with sentence no. 28778 of October 20, 2020 has addressed the issue of divorce settlement in the event that one of the two former spouses starts a new stable relationship, reducing the relevance of cohabitation in favor of the existence of a stable relationship with a new partner. According to the most recent jurisprudential orientation to the cessation of the right to receive a divorce settlement is sufficient the existence of a long-standing and established relationship with a new partner.

The case dealt with by the First Civil Section of the Court of Rome, saw a wife in the divorce, disputing the existence of a stable cohabitation between her and the new partner deduced instead by the former husband, asked to place on the former spouse the burden of paying a monthly sum by way of divorce allowance.

The request made by the lady, on the basis of the most recent case law and in application of established principles, was declared unfounded and therefore totally rejected by the Court of Rome. In fact, the Court pointed out that in the case in question the woman had separated at a very young age, had a specialized qualification that allowed her to easily enter the job market and, moreover, following the separation, had returned to live in the house owned by her family without having to bear any rental costs.

In addition to these elements, the College pointed out that during the course of the investigation had been confirmed the new relationship between the ex-wife and her new partner, directly from the social content published by the lady. For this reason, therefore, the Court of Rome – reaffirming the principle of case law that in order to waive the right to receive the divorce settlement is sufficient the existence of a long-standing and established relationship with a new person, characterized by officialdom, as well as based on the daily attendance with more or less periods of time daily frequentation with more or less long periods of full and effective cohabitation – rejected the wife’s request.
