Quando i genitori non sono d’accordo su scelte importanti, come la scuola per il proprio figlio, possono ricorrere al Giudice.

In questa vicenda riportata dal @corriere del 19 maggio, c’era un disaccordo fra i genitori separati, nella scelta della scuola media. Il padre preferiva una scuola privata che avrebbe, secondo lui dato maggiori opportunità al figlio, la madre preferiva quella pubblica vicino all’abitazione di residenza.  Il bambino, di soli 11 anni è stato sentito dal Giudice, che ha disposto come scelta scolastica futura, quella che il bambino ha indicato!

Ma ci si domanda, è giusto far decidere del proprio futuro un 11 enne? Quanto sarà influenzato dal genitore con cui convive?  In questo caso era la madre a volere la scelta della scuola vicino a casa e il figlio anche, ovviamente, il conosciuto spaventa meno e poter andare a scuola da solo e sicuramente una comodità, anche per il genitore affidatario. Chi ci è passato, chi ha avuto un figlio, sà che la sua scelta sarà il più delle volte quella di stare con gli amici, di seguire il suo gruppo, e poi di assecondare, anche il genitore, spesso la mamma che convive con il figlio, e che vuole questa scelta, spesso per comodità. Ma questo. è veramente il meglio per nostro figlio? E poi, che indagine approfondita avrà fatto questo collegio giudicante?

Se è positivo che anche nei nostri Tribunali, finalmente vengano sentiti i minorenni, bisogna però pretendere che venga anche fatto un vero approfondimento da qualificati psicologi sulle ragioni dichiarate dal minore, per scongiurare ogni eventuale plagio, ad opera del genitore più vicino al figlio in quel momento.

In this case reported by the @corriere of 19 May, there was a disagreement between the separated parents on the choice of the secondary school. The father preferred a public school that would, in his opinion, give his son more opportunities, while the mother preferred a public school near her home.  The child, who is only 11 years old, was heard by the judge, who ruled that the choice of school for the future should be the one the child had indicated!

But is it right to let an 11-year-old decide about his future? How much will he be influenced by the parent he lives with?  In this case it was the mother who wanted the choice of school close to home and the child also, of course, the known frightens less and being able to go to school alone is certainly a comfort, even for the foster parent. Those who have been through it, those who have had a child, know that their choice will more often than not be to stay with friends, to follow their group, and then to indulge, even the parent, often the mother who lives with the child, and who wants this choice, often for convenience. But is this really what is best for our child? And then, what in-depth investigation has this panel of judges done?

If it is positive that also in our Courts, at last, the minors are being heard, it is necessary, however, to demand that a real in-depth examination is carried out by qualified psychologists on the reasons declared by the minor, to avoid any possible plagiarism by the parent closest to the child at that moment.
